Perhaps not surprisingly, there has been a huge increase in data breaches as a result of bad actors (i.e., hacking), failure in internal policies, procedures and implementation (i.e., using untested and unsecure technologies working from home) or both (i.e., falling victim to phishing scams related to the Coronavirus because employees lack proper training for detection and avoidance, etc.).  The U.S. Department of Health and Human Services has reported an increase of more than 100% in healthcare-related breaches since February.  Other industries are reporting similar results, and many breaches are surely not even known as many businesses are not monitoring their employees’ work from home – which would potentially create its own privacy concerns.  Needless to say, in a time when business survival and success for many is quite precarious, you do not want a breach or loss of sensitive data, and loss of customer and client confidence which goes along with that, to occur.   You also certainly do not want to end up like everyone’s new best friend Zoom, and face a lawsuit over your privacy practices or an investigation by the NY Attorney General’s Office over your data privacy and security practices.  While you may not believe now is the time for major financial investments into your data privacy and security practices, putting your head in the sand is also not a sound or practical solution.  There may be interim and small (i.e., easy and inexpensive) steps that you may be able to take to improve your data privacy and security practices and procedures to minimize the chance that the “unexpected” occurs while you are trying to focus on your important business goals.  For more information, please see and other postings at (on data privacy and security issues, as well as very timely and useful updates on Coronavirus relief options and laws), or contact Michael J.
